Yoto Reannounced Recall for Yoto Mini Speakers Over Burn Hazard
CHICAGO, ILLINOIS (December 27, 2024) – Yoto Mini Speakers for children have been recalled because they can pose a fire and burn hazard.
The recall notice was issued on December 12. Over 250,000 units were sold to the public before the recall.
According to the notice by the Consumer Product Safety Commission, the lithium-ion batteries in the speaker may overheat and catch fire.
This may pose a serious risk of burn injury to consumers. The device is a pale grey and has bright orange knobs.
Yoto said it has received nine reports of the device overheating or melting. No injuries have been reported at this time.
Liability for Injuries Caused by Lithium-Ion Batteries
Batteries that contain lithium-ion batteries can be very dangerous in certain circumstances. Among other things, they can lead to deadly fires and cause burn injuries. According to CBS News, “Fires caused by rechargeable batteries, including lithium-ion batteries, have been increasing steadily in large cities like New York and San Francisco. Since at least 2019, fire departments in the two cities say they’ve responded to at least 669 incidents combined.” Several factors could contribute to a lithium-ion battery fire.
- Lithium-ion batteries are susceptible to thermal runaway. This is a chain reaction that can lead to overheating.
- Lithium-ion batteries may be charged with incompatible charging devices.
- Lithium-ion batteries may have impurities in the electrolyte base.
Companies that create products with lithium-ion batteries have a legal obligation to make those products safe. There are a number of ways that a manufacturer could be liable for an unsafe product. For example, a manufacturer may have failed to warn about the non-obvious dangers associated with a product. There are several elements that must be demonstrated in a prima facie case of product liability.
- The defendant sold the product that a plaintiff used.
- The defendant was the commercial seller of the product in question.
- The plaintiff was injured by using the product.
- The product in question was defective when it was sold.
- The defect was the actual and proximate cause of the plaintiff’s injury.
The vast majority of fires and injuries caused by lithium-ion battery fires are preventable. In many cases, companies will use cheaper material in order to cut costs. But these cost-cutting measures can have very serious consequences. Any person that is injured by a lithium-ion battery-powered device may have legal recourse through a civil claim. A products liability attorney can examine all of the unique facts of your case and let you know what your legal options are.
