Question:
I was a passenger in a vehicle that t-boned in a parking lot. I had to be cut out of the vehicle. because it happended on county property, workers comp has gotten involved. The vehicle that we were in was totaled – the insurance company of the individual that hit us told the car owner that we would be double dipping since workers comp was involved – this could not be a true statement coming from this adjuster – what is she trying to achieved by making this statement. She was trying to get the car owner to settle her car loss plus the medical expense. We both were taken away in an ambulance.

Answer:
There is no double dipping here because Workers Compensation will have a lien on any recovery you make from the third party (auto defendant) insurance carrier. The adjuster knows this and as you suspected was being disingenuous.
