The Chicago consumer harassment attorney at Horwitz, Horwitz & Associates represents consumers in various federal courts around the country for violation of federal consumer protection laws. Such laws include the Fair Debt Collection Practices Act (FDCPA) and the Telephone Consumer Protection Act (TCPA).
Increase in violations for protected consumers
Despite the passage of the Fair Debt Collection Practices Act (FDCPA) in 1976, consumer complaints about debt collection abuse continue to increase. Last year, consumer complaints to the Federal Trade Commission (FTC) about third-party debt collectors increase both in absolute terms and as a percentage of all complaints that consumers filed with the FTC during the course of the year. In 2011, the FTC alone received 117,374 FDCPA complaints.
The Telephone Consumer Protection Act of 1991 (TCPA) prohibits using any automatic dialing system, or artificial or prerecorded voice messages to call any telephone number assigned to a cellular telephone service absent an emergency purpose or with the prior consent of the called party. These provisions were enacted to limit solicitors calling consumers. It also aims to keep private phone lines and fax machines from being tied up by these random calls.
In addition, TCPA was intended to eliminate the imposition of advertising costs to recipients who have no prior relationship with the caller. According to the TCPA, repeated telemarketing calls and blasted faxes are considered an invasion of privacy.
