How much is my workers’ compensation case worth?

Mark Weissburg, a partner and Chicago workers compensation lawyer at Horwitz Horwitz & Associates answers a listener’s question on Free Legal Advice Friday’s:

How much is my workers’ compensation case worth?

The value of a workers’ compensation case depends on a lot of variables.

One of the main ones that I see is medical treatment because if no one wants to pay for that medical treatment that’s probably going to be the biggest dollar figure involved in your case.

So, it’s very important to make sure you do all the things you need to do to protect your rights so that you get that medical treatment. So that those bills aren’t coming to you, they are getting paid by workers’ compensation.

Beyond that, there is the weekly benefits that you are entitled to while you are off work. And that can add up to a large amount if you’re off work for a long period of time.

And finally, at the end of the case, there is a settlement of the case, which is what people are usually referring to when the ask how much their case is worth. That can vary depending on:

  • Are you going to be able to go back to your old job or not?
  • Are you going to be able to another type of work?
  • How much does that work pay?

All of those variables are going to factor in because the idea is to compensate you for the loss you suffered.
